1. Acceptance of Terms

By accessing or using the Lift Ai mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

2. Definitions

App The Lift Ai mobile application.

Service All features, functionality, and content provided through the App, including AI-generated workouts, scheduling, progress tracking, and gym partnership features.

User Any individual who accesses or uses the App.

Content Any data, information, workouts, photos, or material uploaded, posted, or shared via the App.

AI-Generated Content Workouts, exercise recommendations, and suggestions produced by the App's AI systems.

3. Account Registration and Security

3.1. To access certain features, you must register for an account using one of the following:

  • Email and Password
  • Apple Sign In
  • Google Sign In
  • Facebook Login

3.2. You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activities under your account.
  • Promptly notifying us of unauthorized use or security breaches.

4. Subscriptions and Payments

4.1. Lift Ai offers subscription-based features, which may include:

  • Basic and premium subscription tiers.
  • Free trial periods.
  • Device-based subscription tracking.
  • Gym-partnered subscriptions unlocked via gym proximity or partner links.
  • Regional payment options (Apple App Store or Stripe).

4.2. Payment terms:

  • Subscriptions renew automatically unless canceled.
  • No refunds are provided for partial subscription periods.
  • Payments are processed via the App Store or Stripe, depending on your region and choice.
  • Apple App Store subscriptions: manage or cancel through your App Store account.
  • Stripe subscriptions: manage or cancel through our in-app billing portal.
  • US users may choose between Apple App Store and Stripe payment methods.
  • Non-US users are processed through Apple App Store.
  • Subscription availability and payment methods may vary by region.

5. User Content and Conduct

5.1. You retain ownership of content you submit through the App, including workouts you create and progress photos you upload.

5.2. You agree not to:

  • Upload or share illegal, harmful, or offensive content.
  • Upload photos of anyone other than yourself without their consent.
  • Impersonate others or misrepresent your identity.
  • Disrupt or interfere with App functionality.
  • Attempt unauthorized access to other users' accounts or the system.

6. Referral Program

6.1. The App may include a referral program that:

  • Provides unique referral codes.
  • Tracks successful referrals.
  • Issues rewards for valid referrals.

6.2. Referral guidelines:

  • Referrals must be made in good faith.
  • Creating multiple accounts to abuse the program is prohibited.
  • We reserve the right to change or terminate the program at any time.

7. Intellectual Property

7.1.

  • The App and its original content, features, and design are the property of Lift Ai and protected by international intellectual property laws.
  • AI-Generated Content: Workout suggestions and exercise recommendations generated by our AI systems are provided for your personal use.

7.2. You may not:

  • Copy, modify, or create derivative works of the App.
  • Reverse-engineer or extract source code.
  • Remove or alter any copyright or proprietary notices.
  • Scrape or bulk-export App content for commercial purposes.

8. Privacy and Health Data

Your use of the App is subject to our Privacy Policy, which describes how we handle your information, including Apple Health / HealthKit data, location data, progress photos, and calendar data. By using features that require access to these data types, you authorize Lift Ai to process them as described in the Privacy Policy.

9. Termination

We may suspend or terminate your account and access to the App at any time, with or without notice, for reasons including but not limited to:

  • Violating these Terms.
  • Fraud or illegal activity.
  • Extended inactivity.
  • Violating any referral program guidelines.
  • Abusing trial periods or subscription features.

10. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind. We do not guarantee that:

  • The App will be error-free or uninterrupted.
  • The App will meet your specific needs.
  • The App will be secure or virus-free.
  • AI-generated workouts will be appropriate for your specific health or fitness condition.
  • Apple Health data displayed in the App is accurate, complete, or up to date — this data is provided by Apple HealthKit and third-party devices and apps, and Lift Ai is not responsible for its accuracy.

11. No Medical or Fitness Advice

Lift Ai does not provide medical advice, fitness instruction, diagnosis, or personalized health recommendations. All content and features within the App — including AI-generated workouts, Apple Health data displays, and progress insights — are for informational and general use only and are not a substitute for professional guidance.

By using the App, you acknowledge and agree that:

  • You are solely responsible for your health, safety, and physical condition.
  • Any use of workout suggestions, AI-generated programs, or other App features is at your own risk.
  • You should consult a healthcare or fitness professional before beginning any new exercise program.
  • Apple Health data displayed in the App is informational only and should not be used to make medical decisions.

Lift Ai, its developers, and affiliates are not liable for any injuries, health conditions, or consequences resulting from your use of the App.

12. Limitation of Liability

To the maximum extent permitted by law, Lift Ai is not liable for:

  • Indirect, incidental, or consequential damages.
  • Loss of data, revenue, or profits.
  • Damages arising from your use or inability to use the App.
  • Damages arising from inaccurate or incomplete Apple Health data.
  • Damages arising from gym-partnered subscription availability or gym access.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated through the App or via email. Continued use of the App constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which Lift Ai is registered, without regard to conflict of law principles.

15. Dispute Resolution

Disputes arising from these Terms will be resolved through:

  • Good faith negotiations.
  • Mediation.
  • Binding arbitration, if necessary.
